An Analysis on the Building Agreement from the Viewpoint of
Environmental Protection

This thesis analyzes the structure and function of the building agreement
from the viewpoint of environmental protection. The building agreement
is implemented to supplement the architectural regulation system originally
after world war Ⅱ in Japan. This agreement which can be regulated by
municipal ordinance, is concluded by the common consent of the owners of
land and the other right holders for improving the quality of environment
in the field of building. The building standards can be interpreted as national
minimum standards for building restrictions. Residents of a particular
community can strengthen the level of existing building standards by making a
separate building agreement.
Some municipal governments try to introduce building agreement as a
means of environmental protection. This system of building agreement has
both advantages and disadvantages. The advantage of this building agreement
is that it can deal with local demands of environmental regulation beyond
existing building standards. But to realize the goal of environmental protection
with the building agreement takes too much time and efforts.
