The Normative Meaning of Environmental Justice
- Based on the triangular relations between the environment, justice, and law -

Within the context of current laws, environmental justice has three meanings. The first represents the environmental protection of people; the second being the assurance of equality throughout the environmental sphere; and the third assuring public participation during the decision-making process.

Like other basic constitutional principles, environmental justice within the current legal system is significant within the framework of the constitution and is valuable. Thus, the constitution of Korea has been written to ensure environmental protection and to designate environmental protection duties for the state. This means that Korea is an environmentally-friendly country with the aim of realizing environmental justice.

Still, the definitions and contents of environmental justice need to be extended in a more positive and future-oriented way, and attempts to legislate and elaborate on the legal logic of environmental justice remain.
